By accessing our Website or using our Services, you agree to be bound by these Terms and Conditions.

2. Definitions

In these Terms and Conditions, unless the context requires otherwise:

• “Client”, “you”, or “your” refers to the individual or entity that has requested our Services.
• “Property” means the premises where our Services are to be provided.
• “Quotation” means a written estimate of the cost of Services to be provided.
• “Services” means mould removal, treatment, inspection, assessment, and any related services as agreed between the Company and the Client.

3. Services

3.1 Service Description

We provide professional mould removal and treatment services, including mould inspection, assessment, removal, and treatment. The specific Services to be provided will be detailed in your Quotation or service agreement.

3.2 Quotations and Assessments

Any Quotation provided is valid for 30 days from the date of issue, unless otherwise stated. Quotations are based on our assessment of the work required. If during the provision of Services we discover additional work is necessary, we will inform you of any additional costs before proceeding.

3.3 Service Limitations

While we strive to resolve all mould issues, we cannot guarantee the complete elimination of all mould or that mould will not return in the future, especially if underlying moisture issues are not addressed. Our Services address the current mould situation but do not guarantee prevention of future mould growth.

3.4 Access to Property

You agree to provide us with reasonable access to your Property to perform the Services. You are responsible for clearing the areas where work is to be performed of furnishings, valuables, and other items, unless otherwise agreed.

4. Booking and Cancellations

4.1 Booking

All bookings are subject to our availability. We will endeavor to provide Services at the agreed time, but circumstances may occasionally necessitate rescheduling.

4.2 Cancellations

If you need to cancel or reschedule a service appointment, please provide at least 48 hours’ notice. Cancellations with less than 48 hours’ notice may be subject to a cancellation fee of up to 50% of the agreed service price.

4.3 Our Right to Cancel

We reserve the right to cancel or reschedule Services due to unforeseen circumstances, including but not limited to illness, equipment failure, or extreme weather conditions. We will endeavor to provide as much notice as possible in such cases.

5. Payment Terms

5.1 Fees

Our fees for Services are as set out in your Quotation or service agreement. All prices are inclusive of VAT unless otherwise stated.

5.2 Payment Methods

We accept payment by cash, debit or credit cards, bank transfer (BACS), or invoice as agreed. Payment terms will be specified in your Quotation or service agreement.

5.3 Deposits and Unforeseen Site Conditions

For larger projects, we may require a deposit of up to 50% of the total project cost before commencing work, with the balance due upon completion of the Services. Except as otherwise agreed in writing, any such deposit is strictly non-refundable upon payment.

If, upon arriving at the site or commencing the Services, we determine in our sole professional discretion that the work cannot safely, effectively, or practically proceed due to:

• Force Majeure events;
• Unforeseen, hidden, or undisclosed pre-existing site conditions (including, but not limited to, mold or contamination that has been painted over, sealed, covered, or structurally encapsulated prior to our arrival); or
• Any misrepresentation, non-disclosure, or prior unauthorized modifications of the work area by the client or third parties;

we reserve the absolute right to immediately suspend or terminate the Services. In any such event, we shall retain the full deposit as compensation for site assessment, mobilization, administrative overhead, resource scheduling, and any preliminary labor or materials deployed, with no obligation to refund any portion thereof to the client.

5.4 Late Payment

Late payments may be subject to interest charges at a rate of 8% above the Bank of England base rate, calculated daily from the due date until payment is received.

6. Warranties and Guarantees

6.1 Workmanship

We warrant that our Services will be performed with reasonable care and skill in accordance with industry standards. If you are not satisfied with our work, please notify us within 7 days of completion, and we will return to address any issues related to our workmanship at no additional cost.

6.2 No Guarantee Against Future Mould

Our Services do not include a guarantee against future mould growth. Mould can reoccur if underlying moisture problems persist or develop. We may provide recommendations to help prevent future mould growth, but implementation of these recommendations is your responsibility.

6.3 Materials

Any materials used in providing our Services are covered by the manufacturer’s warranty only. We do not provide additional warranties for materials used.

7. Liability and Indemnity

7.1 Limitation of Liability

Our total liability to you for any losses arising out of or in connection with our Services, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall not exceed the total amount paid by you for the Services.

7.2 Exclusions

We shall not be liable for:

• Any indirect, consequential, or special losses;
• Loss of profit, revenue, business, or opportunity;
• Damage to items not removed from the work area as requested;
• Pre-existing structural issues or defects in your Property;
• Health issues that may be associated with mould exposure before, during, or after our Services.

7.3 Your Indemnity

You agree to indemnify and hold us harmless from any claims, damages, liabilities, costs, or expenses arising from your breach of these Terms and Conditions or your use of our Website or Services.

8. Intellectual Property

All content on our Website, including but not limited to text, graphics, logos, images, and software, is our property or that of our licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on our Website without our prior written consent.

9. Privacy

Your use of our Website and Services is also governed by our Privacy Policy, which is incorporated into these Terms and Conditions by reference.

10. Force Majeure

We shall not be liable for any delay or failure to perform our obligations under these Terms and Conditions if such delay or failure results from events or circumstances outside our reasonable control, including but not limited to acts of God, natural disasters, pandemic, government actions, war, civil unrest, labor disputes, or failures of suppliers or subcontractors.
